Baroda Medicare Private Limited (hereinafter referred as “SGH”, "we," "us," "our"). 12. Indemnity

Notwithstanding the general indemnity provided to SGH in the Terms and Conditions, You agree and undertake to indemnify and keep indemnified SGH, the concerned doctor/physician and any affiliate for any losses, costs, charges and expenses including reasonable attorney fees that the concerned doctor/physician and SGH may suffer on account of a misdiagnosis / faulty judgment /interpretation errors / perception error arising from:


1. your failure to provide correct and / or complete clinical information / history about the patient in timely and appropriate manner; or


2. suppression of material facts; or your failure to provide relevant clinical information about the patient; or


3. misinterpretation of the advice / prescription / diagnosis by you; or


4. failure to follow doctor’s advice / prescription by you; or


5. incorrect or inaccurate credit / debit card details provided by you; or


6. using a credit / debit card which is not lawfully owned by you; or


7. if you permit a third party to use your password or other means to access your account and deceive SGH in any manner whatsoever.


13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
